Terms of Service
Version v1-2026-10-08
About these terms
Effective date: 2026-10-08.
These Terms of Service are an agreement between you and Objectiv LLC, a Massachusetts limited liability company ("Objectiv", "we", "us"). They govern your use of the Objectiv website and platform and the services we provide through them (together, the "platform").
You accept these terms when you check the acceptance box at sign-up, or when you accept them on the screen that appears when you sign in. We record each acceptance with the version you accepted, a fingerprint of its exact text, and the time.
If you accept these terms for a company, you confirm that you have authority to bind that company, and "you" includes the company. Our Privacy Policy explains how we handle personal information.
Who uses the platform
The platform is built for private employers, including nonprofit organizations. It is not offered to federal, state, or local government employers.
Employers use the platform through one or more administrators. An administrator can add employee records, invite employees, upload documents, and see the information the platform holds for that company.
Employees use the platform when their employer invites them. An employee sees their own record, their benefits, and the tools their employer makes available.
Our staff, including our Massachusetts-licensed insurance producer, also uses the platform to serve you, as these terms and the Privacy Policy describe.
What the platform does
The platform helps employers manage employee benefits and human-resources requirements. Depending on your plan and settings, it can show employment and benefits requirements that may apply to your company, with dates and checklists; keep employee and dependent records; import a census file; analyze plan documents, renewals, and quotes; prepare notices, letters, and other documents for you to review and send; prepare broker-of-record letters for your signature; estimate premiums, costs, and fees; and answer employee questions about their plans through the employee concierge.
Some features use automated drafting and analysis. Everything the platform produces is for you to review before you rely on it.
What the platform does not do
The platform surfaces requirements that may apply to your company. It does not decide which requirements apply to you, and it does not decide which rule controls when two rules overlap. The platform may not show every requirement that applies to you. A requirement missing from the platform is not a statement that the duty does not apply.
Information on the platform is not legal advice and is not tax advice. The requirements, deadlines, and calculations the platform shows are information to help you; they are not a determination that a requirement applies or does not apply to your company. Talk to your own attorney or tax adviser about your obligations.
Objectiv never files anything with a government agency on your behalf. You remain responsible for every filing, payment, notice, and deadline that applies to your company, including the ones the platform shows you.
Premium, cost, rate, and fee estimates are calculations from information you and others provide. They are not quotes, not offers of coverage, and not guarantees of price.
The employee concierge answers questions about plan information. It does not give medical advice.
Insurance services
Insurance services are provided by a Massachusetts-licensed insurance producer, license no. 1788496.
Only an insurance carrier can issue coverage, and coverage takes effect only on the carrier's terms. A broker-of-record letter takes effect only when your authorized signer signs it and the carrier accepts it. We never submit a broker-of-record letter without your signature.
Insurance carriers may pay commissions on coverage placed through us. Ask us and we will tell you how we are paid for your coverage.
Your account
Give us accurate information and keep it up to date. Keep your password secret, and do not share your account. Tell us promptly at the contact address below if you think someone has used your account without permission.
Administrators are responsible for who they invite. Tell us promptly at the contact address below when an administrator leaves your company, so we can remove their access.
Information you provide about other people
When you enter or upload information about employees, dependents, or other people, you confirm that you have the right to share it with us for the purposes in these terms and the Privacy Policy, and that you have given any notice and obtained any consent the law requires.
Provide only the information the platform asks for. Do not upload full Social Security numbers, driver's license numbers, bank account numbers, payment card numbers, or medical records unless a feature specifically asks for them. The census import discards columns that look like Social Security numbers.
Your data
Your company owns the information it provides to the platform. You give us permission to host, copy, process, and display that information as needed to provide the platform and our services to you, as the Privacy Policy describes.
Before you close your company's account, you can ask us for a copy of your company's information, and we will work with you to provide it.
Acceptable use
Do not use the platform to break the law or to harm anyone. Do not try to reach information that belongs to another company or another person, test or bypass security controls, overload the platform, copy it to build a competing product, or use automated tools to extract data from it. Do not upload malicious code or content you have no right to share.
Fees, renewal, and cancellation
The fees for the platform are shown at checkout or on the pricing page. Fees do not include taxes; where the law requires, sales tax is added. Stripe processes payments, and we never receive or store your full payment card number.
A paid subscription renews automatically at the end of each billing period until you cancel it.
You can cancel at any time online, with the Manage Billing button in Settings, without contacting us. Cancellation takes effect at the end of the billing period you have already paid for. Your access continues until then, and you are not charged again. We do not give refunds or credits for any part of a billing period, except where the law requires one.
If we change the fees, we email the billing contact at least 7 days, and no more than 30 days, before the change takes effect, and tell you how to cancel.
Third-party services and links
The platform may link to insurance carriers, government agencies, and other websites we do not control. We are not responsible for their content, their services, or how they handle your information.
Our intellectual property
The platform, including its software, design, and content other than your data, belongs to Objectiv and its licensors. We give you a limited, non-exclusive, non-transferable right to use the platform under these terms while your account is active. If you send us suggestions, we may use them without obligation to you.
Suspension and termination
You can stop using the platform at any time. We may suspend or end your access if you break these terms, if your use creates a security or legal risk, or if your subscription is unpaid. When we can, we will tell you first and give you a chance to fix the problem.
After an account ends, we keep and delete information as the Privacy Policy describes. Sections of these terms that by their nature should continue, such as ownership, disclaimers, limits of liability, and governing law, continue after the account ends.
Disclaimers
To the extent the law allows, the platform is provided "as is" and "as available". We do not promise that the platform will be uninterrupted or error-free, that it will show every requirement that applies to you, or that using it will make your company compliant with any law.
Nothing in these terms limits a duty Objectiv owes you under insurance law that the law does not allow a contract to limit.
Limitation of liability
To the extent the law allows, Objectiv is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from these terms or the platform. Objectiv's total liability for all claims arising from these terms or the platform is limited to the greater of the fees you paid us in the 12 months before the claim arose and $100.
Objectiv does not pay or reimburse any penalty, fine, interest, tax, premium, claim, benefit, or other amount your company owes, including one that arises from a filing, payment, notice, or deadline the platform showed, did not show, or showed incorrectly. If the platform contains an error, your remedy is that we correct it, subject to the limit above.
Any claim arising from these terms or the platform must be brought within one year after it arises, unless the law does not allow a shorter period.
These limits do not apply where the law does not allow them, including to liability for gross negligence or willful misconduct.
Indemnity
If you use the platform for a company, the company will defend and indemnify Objectiv against third-party claims arising from information the company provided without the right to share it, or from the company's breach of these terms.
Governing law and disputes
Massachusetts law governs these terms, without regard to its conflict-of-laws rules. Before filing a claim, each side will try to resolve the dispute informally for 30 days after written notice. Claims that are not resolved go to the state or federal courts located in Massachusetts, and both sides agree to those courts' jurisdiction.
Changes to these terms
When we change these terms, we publish a new version with a new version number. The next time you sign in, you are asked to review and accept it before you continue. If you do not accept a new version, you cannot continue to use the platform, and you can ask us to close your account at the contact address below.
General
These terms and the Privacy Policy are the whole agreement between you and Objectiv about the platform, unless you have signed a separate written agreement with us, which controls where it differs. If a court finds part of these terms unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it. You may not transfer these terms without our written consent; we may transfer them as part of a merger, acquisition, or sale of assets. We send notices by email or in the platform.
